CUSTOMER TERMS OF SERVICE (TOS)

1. Platform Role & Acknowledgment of Independent Contractors
Primeshiners is a technology and lead-generation platform, not an auto detailing company. We provide software that connects consumers ("Clients") with independent mobile auto detailing professionals ("Service Providers").
By booking through the Primeshiners platform, you explicitly acknowledge and agree that:
The detailing services are performed entirely by third-party Independent Contractors, not by employees, agents, or partners of Primeshiners.
Primeshiners does not supervise, direct, or control the Service Providers, nor do we dictate their methods, schedule, or equipment.
Your service contract for the physical detailing work is strictly between you and the Service Provider.
2. The Trust & Safety Fee
To maintain the integrity of our referral network, Primeshiners applies a mandatory, non-refundable Trust & Safety Fee of $4.99 to every booking. This fee is strictly retained by the Platform and does not go to the Service Provider. It funds:
Secure Communications: The maintenance of our encrypted VoIP proxy network, ensuring your personal phone number and data are shielded from third parties.
Platform Security: Identity verification and onboarding verification of the independent Service Providers in our network.
Software Maintenance: The continuous operation of our booking, dispute resolution, and payment gateways.
3. Payments, Cancellations, and Upsells
Primeshiners acts strictly as a limited payment collection agent on behalf of the Service Provider.
Same-Day Modifications: If you request additional services on-site (e.g., headlight restoration, pet hair removal), the Service Provider will update your invoice through our secure platform.
Direct Payments Prohibited: To protect your data and ensure the security of your transaction, all payments and gratuities must be processed through the Primeshiners platform. Paying a Service Provider directly in cash or via peer-to-peer apps (e.g., Venmo, Zelle) violates these Terms and voids any platform support for dispute resolution.
4. Limitation of Liability & Property Damage (The "Damage Shield")
PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LIABILITY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRIMESHINERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROVISION OF DETAILING SERVICES.
PRIMESHINERS EXPLICITLY DISCLAIMS ALL LIABILITY FOR ANY PROPERTY DAMAGE (INCLUDING BUT NOT LIMITED TO PAINT DAMAGE, INTERIOR TEARS, ELECTRICAL ISSUES, OR CHEMICAL BURNS), THEFT, OR PERSONAL INJURY CAUSED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE INDEPENDENT SERVICE PROVIDER.
Any claims for damages, inadequate service, or loss must be directed solely and exclusively to the Independent Service Provider and their respective general liability insurance carrier. While Primeshiners may, at its sole discretion, help facilitate communications to resolve a dispute, we assume no financial or legal responsibility for the physical work performed.
